OUR COMMITMENT TO PRIVACY

Amintro Inc. (“Amintro”, “we”, or “us”) is committed to respecting and protecting your privacy. We have developed this privacy policy (“Privacy Policy”) to help you understand how we collect and use information. This Privacy Policy explains how we gather and use your information, whether due to your use of the Site (as hereinafter defined) or your receipt of services from us directly.

Amintro offers two primary platforms: the first, “Amintro” (the “Amintro Platform”), being dedicated to users who are at least fifty (50) years of age; and the second, “Amintro Family” (the “Amintro Family Platform”), being dedicated to the family members, friends, and associates of the users of the Amintro Platform. The Amintro Platform, Amintro Family Platform, web pages located at amintro.com, friends.amintro.com, family.amintro.com, business.amintro.com, any mobile application that we make available to you (each a “Mobile Application”) and all linked pages together form the “Site”. When used herein, the term “Services” shall refer to any product or services we (i) make available to or perform for you through the Site, including any landing pages or informational pages; or (ii) otherwise provide to you directly, and shall include in-person and online events that Amintro hosts, whether alone or jointly with others.

This Privacy Policy applies to all users of the Site, including both (i) individual users; and (ii) users who use the Site for business purposes, including, but not limited to businesses which are included in the Site marketplace, are promoted on or through the Site, and / or who purchase services from Amintro (“Business Users”).

Please read this Privacy Policy carefully and review it periodically for the latest information about our privacy practices. By using the Site and/or making use of Services, you agree to the terms of this Privacy Policy and consent to the use of your information by Amintro as set forth herein. If you do not agree with the practices described in this Privacy Policy, please do not provide us with your personal information or interact with the Site and/or continue using or taking advantage of the Services.

We will routinely update this Privacy Policy to clarify our practices and to reflect new or different privacy practices, such as when we add new services, functionality or features to the Site and/or Services. If we make any material changes, we will notify you by e-mail (sent to the e-mail address specified in your account) or by means of notice on the Site or directly delivered to you prior to the change becoming effective. You can determine when this Privacy Policy was last revised by referring to the date it was “Last Updated” above. If you do not agree to the revised Privacy Policy, please stop using the Site and/or Services.

THE INFORMATION WE COLLECT

We collect only personally identifiable information (“Personal Information”) that is relevant and necessary to the purpose of the Site and/or Services. This information allows us to provide you with a customized and efficient experience. We collect the following types of information from our users:

  1. Personal Information

We receive and store any information you directly provide through the Site and/or Services or provide to us in any other way, including by e-mail, as further detailed below.

Direct Communication: When you send an e-mail to Amintro or communicate with us by telephone, we may retain your e-mail address or phone number and records of the contents of the communications. Additionally, when you send communications to other users of the Site and / or Services, any Personal Information you include in those communications will be delivered to the user with whom you are communicating.

Voluntary Disclosure: When you choose to provide us Personal Information, such as by filling in forms or corresponding with us, or to include Personal Information in a posting you make on or through the Site and / or Services, we may receive and store that Personal Information. This includes any Personal Information we receive when you choose to link your Account (as defined below) with that of any third-party social media site.

User Account and Public Profile: In order for you to use parts of the Site and/or Services, you will have to complete a registration form and create a user account (an “Account”). As part of this registration process, we may require select Personal Information such as your first and last name, and a valid email address. In certain circumstances, you may also be asked to create a user profile (a “Profile”), in which you may choose to include certain Personal Information, which information will be disclosed as set forth herein. The administrator(s) of Business Users’ Accounts will be required to provide certain Personal Information in order to make use of a Business User Account, including, but not limited to such administrators’ full name and e-mail address.

Purchases: In the event that you purchase a products or services through the Site, you may be asked to provide certain Personal Information.

Payment Information: We do not collect or store any financial information. We contract with PayPal to perform all payment processing on our behalf. Any financial information you provide through the Services is being provided directly to PayPal and PayPal’s use of such information is governed by their then-current privacy policy, which is located at https://www.paypal.com/webapps/mpp/ua/privacy-full.

Non-Provision of Information: Please note that you can choose not to provide us with certain Personal Information, but then you may not be able to take advantage of all of the Services.

  1. Non-Personal Identifiable Information

From time to time, we may also ask you to or you may choose to provide us with non-personally identifiable information, that is, data that is not intended to allow us to identify you personally, such as your first name, birthday, and topics of interest. This information may be aggregated and used for our internal purposes or for creating reports for third-party advertisers and partners (including, but not limited to Business Users), or otherwise shared with third parties for any lawful purpose, without your permission. No third party is intended to be able to know who you are as a result of the use of this information.

In addition to our use of non-personal identifiable information as described herein, we may permit certain third-party companies to help us tailor advertising that we think may be of interest to you based on your use of the Site and / or Services and to otherwise collect and use non-personally identifiable data about your use of the Site and / or Services.

  1. Passive Gathering of Information Electronically 

We may automatically collect Site usage information, such as the numbers and frequency of users of the Site, pages visited and similar data. This data is used in the aggregate, that is, as a statistical measure, and not in a manner that is intended to identify you personally. Aggregate information generally is collected through the use of cookies and web beacons as discussed below. This aggregate information helps us determine general usage patterns and modify the Services and / or Site in order to improve your experience. This type of aggregate information may be shared with third parties at any time.

Amintro receives and stores certain types of information whenever you interact with the Site, including cookies and web beacons. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you register with us, a cookie helps Amintro to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same Amintro website, the information you previously provided can be retrieved, so you can easily use the features that you customized.

A web beacon is a small graphic image that allows the party that set the web beacon to monitor and collect certain information about the viewer of the web page, web-based document, or e-mail message, such as the type of browser requesting the web beacon, the IP address of the computer that the web beacon is sent to and the time the web beacon was viewed. Web beacons can be very small and invisible to the user, but, in general, any electronic image viewed as part of a web page or e-mail, including HTML based content, can act as a web beacon. We may use web beacons to count visitors to the web pages on the web site or to monitor how our users navigate the web site, and we may include web beacons in e-mail messages in order to count how many messages sent were actually opened, acted upon, or forwarded.

In addition to the above, Amintro uses web beacons and cookies to help diagnose problems with its servers, analyze trends and administer the Site and the Services. Third party vendors also may use cookies on our web site. For instance, we may contract with third parties who will use cookies on our web site to track and analyze anonymous usage and volume statistical information from our visitors and members. Such information is shared externally only on an anonymous, aggregated basis. These third parties use persistent cookies to help us to improve the visitor experience, to manage our site content, and to track visitor behaviour.

From time to time, we may allow third parties to post advertisements on our web site, and those third-party advertisements may include a cookie or web beacon served by the third party. This Privacy Policy does not cover the use of information collected from you by third party ad servers. We do not control cookies in such third-party ads, and you should check the privacy policies of those advertisers and / or ad services to learn about their use of cookies and other technology before linking to an ad. We will not share your Personal Information with these companies, but these companies may use information about your visits to this and other web sites in order to provide advertisements on the Site and other sites about goods and services that may be of interest to you, and they may share your Personal Information that you provide to them with others.

You can accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Amintro websites you visit.

HOW WE USE INFORMATION

When you provide us with your information, we may use such information for a number of purposes, including:

  • To facilitate communication between Amintro and you including, without limitation, responding to your questions or comments, sending e-mails concerning our products and services, or to contact you for feedback regarding us, our advertisers or our business partners, which may include the provision of your information to a third party for the purposes of managing our email communications;
  • To administer your Account and provide products or services to you and other users of the Site, including providing users with a list of suggested users to connect with;
  • For Amintro marketing and promotional activities;
  • To provide you with important functionality changes to the Site and / or Services, new services, and special offers from Amintro and reputable third parties that we think you will find valuable;
  • To customize, analyze, adjust and improve the Site and / or Services to meet our or our business partners’ needs and expectations;
  • To process purchase transactions you make through the Site and / or Services;
  • To enforce our agreements with you, prevent fraud and other prohibited or illegal activities, for other legally permissible purposes and generally to ensure that we comply with applicable laws; and / or
  • To contact you with non-essential business communications by e-mail, if you have opted to be contacted by Amintro by e-mail.

DISCLOSURE OF INFORMATION TO THIRD PARTIES

Rest assured that we neither rent nor sell your Personal Information to anyone and that we will share your Personal Information only as described below.

  1. Other Users

Information included in your Profile will be displayed to other users of the specific Site on which your Profile is hosted (for example, Amintro Profiles are viewable only to other Amintro users and Amintro Family Profiles are viewable only to other Amintro Family users) as well as to Business Users.

  1. Published Content

Amintro makes certain portions of the Site available to the public, including, but not limited to, forum postings and comments, and business user content such as videos or articles. When making such content available to the public, Amintro will hide the user name of the user who made such content available on the Site. However, to the extent that you include Personal Information in any such other content, that Personal Information will be available to members of the public to the extent that the content in which it is contained is made available to the public. Additionally, any Personal Information contained in any content you make available on or through the Site will be viewable by other Amintro users.

  1. Fulfilment of Services

We may retain other companies and individuals to perform certain functions on our behalf. Examples include, but are not limited to, companies and individuals who: (i) administer the Amintro accounts; (ii) process payments; (iii) conduct surveys or promotional activities; (iv) deliver products or services; or (v) provide customer support, web hosting, internet service, and data analysis. Such third parties may be provided with access to information needed to perform their functions but may not use such information for any other purpose.

  1. Protection of Amintro and Others

We may release Personal Information when we believe in good faith that release is necessary to comply with a law; to enforce or apply our terms of use and other policies; or to protect the rights, property, or safety of Amintro, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

  1. Business Transfers 

In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that are transferred. Moreover, if Amintro, or substantially all of its assets, were acquired, user information would be one of the assets transferred.

  1. Amintro Personnel 

Amintro personnel and authorized consultants and / or contractors may have access to Personal Information, where such access is necessary in the normal course of Amintro business.

IMPORTANT DISCLOSURES, PRACTICES AND CONTACT INFORMATION

  1. Postings

You understand that by making any postings on or through the Site, any content contained therein (“Shared Content”) may be copied, used, modified, or distributed by any other users, and that this cannot be controlled by Amintro and that, additionally, such Shared Content may be publicly viewable. Further, you understand that once you have posted or published Shared Content, while you have the option of removing your Shared Content from the public areas of our Site, it cannot always be withdrawn from the internet, for example, if you or other Site users have shared or posted it to websites we do not control. Please consider carefully what Shared Content you choose to share, if you do not wish your Personal Information to be shared or publicly available in this manner, please do not include it in the Shared Content you choose to share. You should not post or publish sensitive information, such as financial information, in your Shared Content. You hereby agree that Amintro has no responsibility or liability whatsoever for any such activities. You assume all risks associated with your Shared Content including, but not limited to, any third party’s reliance on its quality, accuracy, or reliability, or any disclosure of information in your Shared Content that makes you or others personally identifiable. You hereby agree that Amintro has no responsibility or liability whatsoever for any such activities.

  1. Linkage to Third Party Sites

To the extent you link your Account to any third-party sites or services (each a “Third Party Service”) (including but not limited to social media sites), such Third Party Services are not subject to this Privacy Policy and as such, their collection and use or your information, including your Personal Information, cannot be controlled by Amintro and we are not liable for any collection, use, or disclosure by such Third Party Services of any Personal Information you choose to make available to or through any Third Party Services, whether through the Site or otherwise. Your use of Third Party Services is governed by any privacy policy or other terms and conditions they have in place from time to time.

  1. Third Party Persons and Referrals

You may not provide us with the Personal Information of another person, or post someone else’s Personal Information on the Site, unless you have the consent of that person. If you choose to provide us with the Personal Information of another person, you represent and warrant that you have their permission and consent to do so, and their agreement to the terms of this Privacy Policy, as well as that of their parent or legal guardian if they are below the age of majority in their jurisdiction of residence.

Certain portions of the Site may permit registered members to refer their friends and family to the Site. If you provide a referral, you may only provide the information or email addresses of friends or family if you have received permission to provide their information and email address to Amintro. Each friend or family member will be sent one email inviting them to join the Services (either the Amintro Platform, the Amintro Family Platform, or another portion of the Services, depending on which portion of the Services the referring user uses). This message will indicate that it has been sent on your behalf and will identify you. The email address of your family or friends will only be used by Amintro for the purpose of contacting your friend(s) or family, on your behalf, to provide the message have chosen to send them. They will not be added to any direct marketing list or used in any direct marketing programs without their consent.

  1. Access and Rectification

You may view and change the information contained in your Account by logging into your Account. You may also cancel your membership and remove your Profile at any time by following the instructions contained in the Account settings.

You have a right to request access to your Personal Information and to request a correction to it if you believe it is inaccurate. If you have submitted Personal Information to Amintro and would like to have access to it, or if you would like to have it removed or corrected, please contact us using the contact information provided below. We may require you to verify your identity before we provide you with access to your Personal Information. We will use reasonable efforts to comply with your request; however, in some cases we may not be able to allow you to access certain Personal Information in certain circumstances, for example if it contains Personal Information of other persons, or for legal reasons. In such cases, we will provide you with a reasonable explanation of why it is not possible to grant access to your Personal Information.

  1. Compliance with Laws.

You are responsible for complying with all applicable laws when you communicate or interact with another person through the Site, including without limitation, all privacy and anti-spam legislation.

  1. Third Party Links

We are not responsible for the practices employed by web sites linked to or from our Site or Services, nor for the information or content contained therein. Please remember that when you use a link or go from our Site or Services to another web site, including those sites that have a link on our Site or Services, you are subject to that other web site’s own rules and policies. Please read over those rules and policies before proceeding. We are not responsible for such third-party site’s collection and / or usage of your data.

  1. Data Security

We maintain a variety of commercially reasonable safeguards designed to protect your Personal Information from unauthorized access and disclosure. For example, we use industry accepted tools and techniques to protect against unauthorized access to our systems.

You should be aware, however, that Amintro has no control over the security of Third Party Services, or any other web sites on the Internet that you might visit, even where such other site is linked to our Site or Services. If you share your computer or use a computer that is accessed by the general public, remember to sign off and close your browser window when you have finished your session. This will help to ensure that others cannot access your information.

We want you to feel confident using the Site and Services. However, no system can be completely secure. Therefore, although we take commercially reasonable steps to secure your information, we do not promise, and you should not expect, that your information, searches or other communications always will remain secure. In the event of a breach of the confidentiality or security of your information, we will notify you if reasonably possible and as reasonably necessary so that you can take appropriate protective steps. We may notify you under such circumstances using the e-mail address(es) we have on record for you. You should also take care with how you handle and disclose your information.

  1. Children

Amintro does not intentionally collect information about children under the age of 13. If we learn that Amintro has collected information from a child under the age of 13, we will delete that information as quickly as possible. We require that minors between the ages of 13 and the age of majority in the applicable jurisdiction ask and receive a parent’s or guardian’s permission before using the Site and / or Services or sending information about themselves or anyone else over the Internet. If you are under the age of majority in your jurisdiction, you warrant that you have the express permission of your parent or legal guardian to use the Site and the Services and to give information about yourself to the Site. If you are a parent or legal guardian and have authorised a minor to use the Site and Services, you (i) agree that you are responsible for the online conduct of the minor, and for the consequences of any misuse of the Site and / or Services by the minor; and (ii) consent to the collection, use, and disclosure of the minor’s information as set forth herein.

The Site is hosted in Canada and is governed by Canadian law. If you are visiting the Site from outside Canada, please be aware that your information may be transferred to, stored, and processed in Canada, where our servers are located and our central database is operated. The data protection and other laws of Canada and other countries might not be as comprehensive as those in your country. By using the Site, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share that information as described in this Privacy Policy.
